1. ACCEPTANCE OF TERMS

By purchasing, registering for, or accessing the Positive Response Dog Training online course, you agree to be bound by these Terms of Service.

The Course is provided by Positive Response Services Pty Ltd ("we", "us", "our" or "Positive Response").

You must be legally capable of entering into a binding agreement to purchase and use the Course. Your Course access is personal to you and cannot be transferred or shared without our written permission.

2. THE ONLINE COURSE

The Course provides online dog-training education and may include videos, written materials, exercises, worksheets, progress activities and other online resources.

The Course is designed around positive reinforcement and force-free training principles.

We may use third-party platforms and service providers to deliver the Course, manage accounts, process payments and communicate with you.

We may reasonably update or modify Course content, technology or delivery methods from time to time.

3. 12-MONTH SUBSCRIPTION

Your subscription begins when your registration and payment are accepted and continues for a fixed period of 12 months.

Your subscription does not automatically renew.

At the end of the 12-month term, your Course access will expire unless you manually renew your subscription and pay the applicable renewal fee.

Renewal pricing may differ from your original subscription price.

4. PAYMENT

Payment methods may include debit card, credit card and other payment methods made available by us or our payment providers.

Payments made through a third-party payment provider, such as Afterpay, are also subject to that provider's terms and conditions and privacy policy.

If a payment fails, we may contact you to update your payment details or arrange payment. Subject to applicable law, we may suspend Course access while an amount remains outstanding.

Payment processing may be provided by third-party payment providers and may be subject to their terms and privacy policies.

5. REFUNDS AND CANCELLATION

The Course is sold as a fixed 12-month subscription.

If you change your mind after purchasing the Course, you may not be entitled to a refund solely because you no longer wish to participate, subject to your rights under the Australian Consumer Law.

If we are unable to provide the Course, we will provide any remedy required by applicable law.

If your dog passes away, you may contact us with appropriate supporting documentation, such as a veterinary letter. Any refund or alternative arrangement will be considered on a case-by-case basis and remains subject to applicable law.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded.

6. AUSTRALIAN CONSUMER LAW

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

Where the product is functioning and operating as intended, issues experienced by the client will not, in themselves, constitute a failure of the product or service.

A major failure will only be considered where there is sufficient evidence that the product has failed to provide the intended service or has otherwise been ineffective. Any request for a refund must be supported by evidence demonstrating that the product has not been effective in achieving the intended outcome.

The client may record and document the dog’s progress throughout the training programme, including through video evidence. This evidence may be used to assess whether reasonable progress has been made.

For a failure that is not considered a major failure, the business may first seek to address or rectify the issue within a reasonable time. A refund or ex gratia payment may only be considered where there is sufficient evidence that the product has been ineffective and that reasonable progress has not been achieved despite the product being used as intended.

Any refund or ex gratia payment will be considered on the basis of the individual circumstances and the evidence available.

Nothing in these Terms is intended to limit your rights under the Australian Consumer Law.

7. YOUR RESPONSIBILITIES

You are responsible for:

• Providing accurate registration information.

• Keeping your login details secure.

• Not sharing your Course access with another person.

• Following the Course instructions and participating consistently.

• Using appropriate care and supervision when training your dog.

• Seeking veterinary or appropriately qualified professional assistance where your dog's health, safety or behaviour requires it.

Every dog is different. We do not guarantee a particular training result, behavioural outcome or timeframe.

You should stop an exercise if your dog shows signs of pain, distress, fear or unsafe behaviour.

8. TRAINING METHODS AND SAFETY

Positive Response Dog Training uses positive reinforcement and force-free training methods.

We do not endorse training methods or equipment intended to cause pain, fear or harm, including shock collars, citronella collars and check chains.

The Course provides general educational information and is not a substitute for veterinary advice, medical advice or individual professional behavioural assessment.

You remain responsible for your own safety and the safety and welfare of your dog while undertaking training.

9. ASSISTANCE DOG TRAINING

Participation in the Positive Response Assistance Dogs (PRAD) programs is subject to additional eligibility and training requirements.

Completing this online Course does not qualify your dog as an assistance dog.

Further assessment and individual training is required, and participation does not guarantee that your dog will qualify as an assistance dog.

All Course videos, written materials, training instructions, worksheets, graphics, images, audio, documents, branding and other Course content remain the property of Positive Response Services Pty Ltd or the relevant rights holder.

Your subscription automatically expires at the end of the 12-month subscription period unless you manually renew it.

We may suspend or terminate access where reasonably necessary due to serious misuse, unlawful conduct, unauthorised sharing of Course materials or account access, material breach of these Terms, or non-payment, subject to applicable law.

Termination or suspension does not remove any rights or obligations that have already accrued.

Nothing in these Terms prevents you from exercising rights available to you under the Australian Consumer Law.

15. LIABILITY

To the extent permitted by law, we are not responsible for outcomes arising from your misuse of the Course, failure to follow instructions, failure to seek appropriate professional assistance, or circumstances relating to your dog's individual health, behaviour or environment.

We do not guarantee that the Course will be uninterrupted or completely free from technical errors.
